It is useful to reread it sometimes, for example, when a fresh thought has arisen in your own head: "both eyes of the lieutenant should be extinguished with one blow." So, about prevention. In our Armed Forces, it is carried out by various effective methods and sometimes in very original forms. One of them is a guided tour. For example," in civilian life " young people who are prone to hooliganism are not collected from all over, say, the region, in order to take them to a general regime penal colony and clearly show how prisoners are corrected "on the cormorant", that is, for hooliganism. And in the army, even in our difficult times, they can find an opportunity to organize an excursion of a motley group, affectionately speaking, sloppies from all over a certain military district to a special separate military unit, called a disciplinary battalion or a disciplinary company. By the way, many civilian people call these parts penalties. This is not true, because penal battalions and companies existed during the Great Patriotic War, and in our-relatively peaceful-time, the system of the Ministry of Defense of the Russian Federation provides for disciplinary military units, where military personnel carrying criminal penalties are tried to correct not by firing enemy machine guns, but by completely different means. So, we invite our readers from among those who are not completely law-abiding to take a correspondence excursion to disbat. Without an escort. You can get into disbat in this way. Criminal punishment in the form of detention in a disciplinary military unit on the basis of Article 55 of the Criminal Code of the Russian Federation is imposed on military personnel undergoing military service on conscription, as well as under contract in the positions of ordinary and non-commissioned officers, if they have not served the term of service established by law on conscription at the time of Thus, those who have committed not too serious crimes against military service, as well as those convicted under other articles of the Criminal Code of the Russian Federation, may be punished if the nature of the crime and the identity of the perpetrator indicate that it is possible to replace imprisonment for a term not exceeding two years by keeping him in a disciplinary military unit for the same It is noteworthy that the sentence can also be imposed conditionally - for a period of 3 months to 2 years. Staying in a disbat will not affect your right to be elected, for example, as a deputy of the State Duma: the criminal record is expunged in a year-either after serving the sentence "from call to call", or after a court decision on parole (conditional early release). By the way, there is a good tradition associated with making such definitions directly in the disciplinary part. That is, the visiting composition of the court sits right in this place not so far away and reviews the cases of, so to speak, realized and reformed candidates for parole. However, it is not a problem directly in the disbat to get a new term and move to a colony of strict or enhanced security. Although detention in a disciplinary military unit is a criminal penalty for a crime committed, imposed by a court verdict, the disbat is still a military unit of the Ministry of Defense, and convicted persons are military personnel. The life of the so-called variable composition (convicted military personnel) is regulated by Chapter 20 of the Military Executive Code of the Russian Federation, which entered into force on July 1, 1997; Government Decree No. 669 of June 4, 1997; order of the Minister of Defense of the Russian Federation No. 302 of July 29, 1997 and, of course, general military regulations. The normative legal documents define that the purpose of this punishment is " correction of convicted military personnel in the spirit of accurate implementation of laws and military regulations, education of discipline, conscious attitude to military service, fulfillment of military duties assigned to them and requirements for military training." The disciplinary part begins for the convicted person with the quarantine department, where he can spend up to 15 days. Here he will have an in-depth medical examination and examination, be comprehensively studied for moral and psychological qualities, as well as attend classes in the main subjects of combat training. The disciplinary unit commander then decides which unit to send the quarantined person to. We will immediately upset those who do not want to upset parents who, for some reason, do not know about their son's problems with the law: the commander of a disciplinary military unit is obliged to send a notification to the relevant court and one of the close relatives of his new subordinate within ten days after the arrival of the convicted person. In a disbat (disciplinary company), the main means of correction are: regime, compulsory labor activity, the use of educational measures of influence, constant military training. Don't believe me if someone says that in the disciplinary units, the time for sleeping is significantly reduced, but there is no limit for work and they are fed, they say, once a day. In fact, the daily routine established for convicted military personnel provides for eight-hour work in production, the same duration of night sleep and three meals a day. Military training sessions - 6 hours weekly. Of course, all those serving sentences in a disciplinary military unit wear military uniforms and have military ranks (private or, if the case occurs in the navy, sailor). The disciplinary military unit, of course, is very different from the usual one. The variable composition of military personnel, informally referred to as convicts, is located in an area protected by an armed permanent composition (called a convoy), which is fenced with a strong high fence and two rows of barbed wire. And, of course, in the rooms with bars on the windows. In addition to the residential area, there is usually a working (production) area. If there is none, the convicted servicemen are taken out of the unit under escort. Labor, of course, should be paid. It is determined that half of the earned income is transferred to the account of the disciplinary military unit "for reimbursement of expenses for the maintenance of convicted military personnel, for the arrangement of the production base, the formation of a material incentive fund and solving the social and household needs of convicted military personnel. The rest of the convicts ' salaries are credited to their personal accounts." Funds from personal accounts are allowed to be spent on the so-called stall. But only in the amount equal to one minimum wage per month. Plus, for the same purposes (purchase of food and basic necessities), you can spend all the monthly allowance due to a serviceman... But, as they say, you should not roll your lip on the topic "earn serious money in disbat". In the current economic conditions, labor activity may consist in "performing work on the arrangement of a part", which is also provided for by regulatory legal documents. And this, as you might guess, is mostly paid for with a bagel hole or about two kilograms of last year's snow. The procedure for executing and serving a sentence (regime) involves providing those held in a disciplinary military unit with short-and long-term visits with relatives and other persons. Including-as a measure of encouragement. The order of visits is defined by Article 158 of the Criminal Executive Code of the Russian Federation. It should be noted that convicted military personnel may have multiple meetings with a lawyer, including in private. If someone is interested in the right of convicts to receive parcels, transfers, parcels, as well as receive and send letters and telegrams-this is stated in articles 159, 160 of the Criminal Code of the Russian Federation. By the way, according to article 162 of the Penal Code of the Russian Federation, serving military personnel are allowed short-term trips outside the disciplinary military unit: in connection with exceptional personal circumstances, such as the death or serious illness of a close relative that threatens his life; a natural disaster that caused significant material damage to the serving person or his family. You may be allowed to leave for up to 7 days, not counting the time required for the road. Separately, it should be said about the educational work carried out by the command of the disciplinary military unit. According to regulatory legal documents, public and state training and informing of military personnel is carried out here, legislation is brought up and explained, individual educational work is conducted, amateur artistic activities, mass sports and other events are organized. If the command considers that the convicted serviceman is confidently following the path of correction, then such a person may be stimulated by changing the conditions of detention for the better (Article 166 of the Criminal Code of the Russian Federation). In disbats, there are units with light conditions for serving sentences for this purpose. Once there, the convict becomes, as they say, de-escorted and receives a number of regime exemptions. But for violation of the established (light) order, a serviceman can be re-installed in his old place. What gives disbat is a thorough knowledge of general military regulations and decent combat training. As a rule, a person who returned "after the deadline" to serve in his native part (on the ship) stands out sharply from the general background with knowledge of these subjects. This is achieved by the fact that military training and military training are built in disciplinary units on the basis of special programs that include an in - depth study of the statutes of the Armed Forces, general legislation and, in particular, its military unit, drill, tactical and combat training (of course, weapons are used for training-without bolts, bayonets or bayonets). Concluding our correspondence tour of the "soldier's zone", we must frankly admit that despite all the good legislative intentions and correctional and educational efforts of the command of such units, the conditions and interpersonal relations there in principle differ little from those that prevail in"civilian places not so remote". However, what can we say if the criminal worldview has taken over a large part of society, and the slang term "lawlessness" has firmly entered the modern literary Russian language and, in general, quite accurately characterizes the events of the last period of our modern history. But in the wild, you can still somehow choose at least a social circle, which cannot be done in conditions of deprivation of liberty. Therefore, without renouncing prison and a purse, you should, of course, make every effort to avoid both, while remaining a law-abiding citizen. And disciplined military personnel.
